Disablement Gratuity

Disablement is a condition caused by an employment injury which has permanently reduced or is likely to reduce permanently earning capacity of a secured person, as certified by a Medical Board constituted by the Institution for this purpose. Disablement shall be “MINOR” where the loss of earning capacity is assessed by the Medical Board upto 20% and the secured person will be entitled to disablement gratuity which is paid in lump sum and is calculated by the following formula;

 

75% of last rate of wages x degree of disablement  x 910

A secured person who is or has been in receipt of injury benefit shall be referred to Medical Board on the recommendation of treating Medical Officer for assessment of degree of disability; if any. Generally the secured person are referred to Medical Board after the end of injury benefit or on completion of medical treatment. In cases where the disablement is quite apparent and the treatment is likely to continue after 160 days of payment of injury benefit, such cases are referred to Medical Board on Form B-10 for assessment with a view to award the cash benefit immediately after the payment of injury benefit is stopped. Formal claim of secured person in receipt of injury benefit is not required. The findings of the Medical Board regarding assessment of loss of earning capacity of a secured person are recorded on form M-8.

 

There is no limit on the number of gratuities to be awarded to any secured person who suffered several injuries, each resulting in ‘Minor’ disablement.
